MarketingSoda, LLC is the data controller for the personal information you provide through the MarketingSoda waitlist. We have not appointed a Data Protection Officer, as we do not meet the thresholds for mandatory DPO appointment under GDPR Article 37. Information We Collect
Information You Provide
- Email address. When you join the MarketingSoda waitlist, we collect your email address. This is the only personal information you provide directly.
We do not collect your name, phone number, payment information, or any other personal data during the waitlist phase.
Information Collected Automatically
When you visit our website, our hosting infrastructure may automatically record:
- IP address — used to deliver the page to your browser and for security purposes
- Browser type and version — included in the HTTP request your browser sends
- Referrer URL — the page you were on before visiting our site, if your browser sends this information
- Date and time of access
This server-side log data is not linked to your email address and is retained only as long as necessary for security and operational purposes (up to 90 days).
Information We Do Not Collect
We do not use advertising cookies, tracking pixels, or behavioral analytics tools on this site.
How We Use Your Information
We use your email address solely for the following purposes:
- Waitlist communication. To notify you when MarketingSoda launches or when early access becomes available.
- Product updates. To send you relevant updates about MarketingSoda's development and milestones.
- Announcements. To inform you of changes that may affect your waitlist position or status.
We do not use your email address for third-party advertising, remarketing, or any purpose unrelated to the MarketingSoda product and waitlist. We do not sell, rent, or trade your personal information to third parties.
All commercial email communications will include our physical mailing address and a mechanism to unsubscribe at any time, as required by the CAN-SPAM Act.
Legal Basis for Processing
For users in the European Economic Area (EEA) and United Kingdom:
We process your email address on the basis of consent under GDPR Article 6(1)(a). You provide your email address voluntarily by submitting the waitlist form, with knowledge that you will receive MarketingSoda-related email communications.
You may withdraw your consent at any time by emailing legal@marketingsoda.ai or by clicking the unsubscribe link in any email we send. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.
Providing your email address is entirely voluntary. You are under no obligation to join the waitlist, and declining to do so has no adverse consequences.
Third-Party Service Providers
We share your email address only with the following third-party data processors, each acting under our instructions:

HubSpot stores and processes your email address to enable waitlist management and email delivery on our behalf. HubSpot acts as a data processor under MarketingSoda's instructions and may not use your data for its own marketing purposes.
We require all third-party processors to process your personal data in accordance with applicable law and in a manner that is consistent with this Privacy Policy.
We do not sell your personal information to any third party. We do not share your email address with any third party for their own marketing purposes.
International Data Transfers
MarketingSoda, LLC is based in the United States. If you are located in the European Economic Area (EEA) or the United Kingdom, your email address may be transferred to and processed in the United States when it is stored in HubSpot's systems.
Such transfers are covered by one or more of the following safeguards:
- Standard Contractual Clauses (SCCs) adopted by the European Commission, as incorporated in HubSpot's Data Processing Agreement
- HubSpot's certification under the EU-US Data Privacy Framework, where applicable

Data Retention
We retain your email address:
- For as long as you remain on the waitlist, or
- For as long as the MarketingSoda product is active, or
- For a maximum of three (3) years from the date of collection — whichever period is shorter
Server logs are retained for up to 90 days. You may request deletion of your email address at any time (see "Your Privacy Rights" below). We will process deletion requests within 30 calendar days.
Cookies and Tracking Technologies
We do not use analytics cookies, advertising cookies, or tracking pixels on this site.
Our website loads fonts from Google's servers via the Google Fonts CDN. This request may transmit your IP address to Google and is subject to Google's privacy policy. If this concerns you, you may use a browser extension to block third-party font requests.
No persistent cookies are set for advertising or behavioral tracking purposes. You may disable cookies in your browser settings; this may affect site functionality. If we add analytics or tracking tools in the future, we will update this policy and, where required by law, obtain your prior consent.

Rights Available to All Users
Regardless of where you are located, you have the following rights with respect to your personal information:

- Deletion. You may request that we delete your personal information.

California Residents (CCPA / CPRA)
If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), provides you with additional rights regarding your personal information.

We collect one category of personal information: identifiers (specifically, your email address).
Business Purpose for Collection
We collect your email address for the following business purpose: managing waitlist registrations and sending pre-launch communications for the MarketingSoda product.
Sale or Sharing of Personal Information
We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising purposes.
Your California Privacy Rights
As a California resident, you have the right to:

Children's Privacy
The MarketingSoda waitlist service is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected personal information from a child under 13, please contact us at legal@marketingsoda.ai and we will delete that information promptly.
Data Security
We implement reasonable technical and organizational measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. These measures include use of HTTPS for all data transmission and access controls on systems that store your information.
No method of transmission over the internet is 100% secure. If you have reason to believe that your interaction with us is no longer secure, please contact us immediately at legal@marketingsoda.ai.
Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. If we make material changes, we will notify waitlist members by email prior to the changes taking effect. The "Last Updated" date at the top of this policy indicates when it was last revised.
Your continued presence on the waitlist after the effective date of any updated Policy constitutes your acceptance of the revised Policy.
